One More Day!

You have one more day to get your application and resume delivered to town hall if you want the privilege of serving as councilmember to the good folks of Ruston. The council will appoint a town resident to fill the vacancy created by Dorothy Bailey's resignation. That person will hold that office until the next regular election in 2013. The council has invited anyone interested to submit applications through the end of January, at which time they will interview applicants before making their decision.

There is no word yet if anyone has tossed their hat in the ring. Bryan Ficiala had mounted a last minute write-in campaign against Ms. Bailey. Several council members encouraged out-going councilmember Bradley Huson to consider sticking around two more years. The deadline for applicants is tomorrow at 5 pm. Drop your paperwork off at Town Hall (5117 N. Shirley) if you are interested.

New Chevron Station Opening Soon

New owners AJ and Patty were very gracious when I stopped in today to check out the remodel of the gas station on N. 51st and Pearl. They have opened up the former garage bay to offer an expanded selection of grocery and other items. The station will continue to offer Chevron gas. They hope to be open for business in a month or so and promise to send more details and pictures soon.

Here's hoping the renewed activity on that corner sparks more new storefronts opening across the street!

Help Set A World Record

Ruston Fire Department has an ambitious goal; to put Ruston in the Guinness Book of World Records for having the highest ratio per capita of residents trained in CPR. The first class is tomorrow and there are only 12 slots open. There will be more classes offered later and there is no cost. More details are available on the town web site here. Vashon Island Ferry May Be Eliminated

Exit 133 is reporting (here) that the state is considering cutting the Vashon Island-Point Defiance ferry due to the budget crisis. Although the move might make life in our neighborhoods quieter, the traffic reduction would negatively impact our retail shops.

Any thoughts or concerns? Would this mean that Pearl loses its state highway designation (and state funding)? Would that mean increased maintenance costs for Ruston? Is a quiet neighborhood more important than busy stores?

Although I never met Mary McDonald, her obituary in yesterday's paper was interesting (thanks for pointing it out, Jim). She was born in Ruston but grew up on Sunrise Beach near Gig Harbor. She often told the story of her dad rowing her mom and herself home and dumping them in the water upon arrival. Her parents homesteaded there in 1901 and she was born in 1906. Since I grew up on that area, I would have loved to hear her stories about the old days of the shoreline at both her homestead and here in Ruston...

Ted Shaffer

I have been remiss in not getting this notice up till now. Longtime owner of the corner gas station Ted Shaffer died last month. His daughter Jane and son Bob ran the operation at 51st and Pearl during the last decade or more. Ted was born and raised in Ruston. His mother lived here most of her life as well. He carried more history of this town than we'll ever know and was a mainstay both economically and visually with his business.

Ted Shaffer, owner of Shaffer’s Automotive, passed away 12-16-2011 to be with our Lord Jesus Christ. He died quietly in the hospital after a massive stroke. He is preceded by his wife of 58 years Marilyn and is survived by his children, Jane, John and Bob. Ted and Marilyn had seven grandchildren and five great-grandchildren.

Ted grew up in Ruston and volunteered to serve our Country at age 17 in 1942. He participated in the Pacific during WWII in the invasion of Saipan, Palau, Tanya and Okinawa. After the war Ted became a Journeyman Machinist working at the railroad then at the Bremerton Naval Shipyard. Ted will be remembered most as the owner of Shaffer’s Automotive, a business he started in 1955 and operated for 55 years.

Council Meeting: Dec. 19, 2011

I'm still trying to catch up... Here is what I found intersting from the December 19th council meeting:

The meeting began at 7:05 pm with all council members present (Councilmember Kristovich arrived after the study session). After the flag salute, business item 5 was changed to Resolution 1350 instead of Resolution 501 because it needed to be approved tonight (to balance the year-end budget). The agenda was approved as amended. The minutes from September 19^th, October 3^rd and 17^th were approved as presented with no changes.

Staff Reports

Police: Chief Kunkel gave the run down on the calls for November (I could not hear most of it). There were no questions from the council.

Fire: Chief Torbet reported that the new breathing apparatus had been ordered. There was a discussion about what changes were needed to the fire department budget to cover the expense. Councilmember Hardin asked for an update on the fire fighter injured at the academy. Torbet said they are recovering and the academy is not going to charge them for the training. The fire fighter will repeat the course next year.

Sewer: Town engineer Jerry Morrisette provided an update on the sewer replacement project. The contractor is making good progress given the dry December weather. The two houses on Shirley Street that had flooded basements had previously had their storm sewers connected to their sanitary sewers. When the sewer was replaced, those illegal connections were removed. The mayor has directed the engineer to explore ways for the town to pay to connect the storm sewers correctly on these properties (both are elderly owners) while other funding is sought to repay the town. It sounds like there will be money available to the property owners, but it will take some time.

Public Comment

Ron Stanley of 5227 N. Highland complained about the change in water flow onto his property after the sewer work in his area.

Business

1. Pine Cone Exercise: Barbara Nelson from Pierce County Emergency Management explained this was a statewide exercise scheduled for June 5^th to test the emergency management system. Ruston is invited to participate. The deadline to confirm participation was today (December 19^th). I didn’t hear a clear response from the council.

2. Ordinance 1340 – Street Excavation Permit Standards (2^nd Reading): The town attorney outlined the new regulations, which exclude small scale landscaping if the excavation is less than 12 inches. There are potential applicants that would fall under this regulation so she urged action now. The measure passed 5-0.

3. Ordinance 1348 –Master Use Permit (1^st Reading): This would apply to entities doing multiple excavation and is modeled after state law. The attorney said she would bring back an ordinance that lays out the fees for all these permits. The council did not have any further comment.

4. Ordinance 1347 – Right of Way Encroachment Permit (3^rd Reading): The town attorney said the permit would be required for any structure within the town right of way and must be renewed annually. It requires that the property owner insure the structure and indemnify the town from liability. Councilmember Hardin did not want it to apply to driveways and walkways. He felt it was onerous to suddenly require yearly permits for longstanding structures like this. The council confirmed that grass and flowers were ok, but not trees. Both Councilmembers Huson and Hedrick felt the definitions were too broad as presented. Huson stated that he does not even have a town license for his dog, the last thing he was going to do was get an annual license for his hedge.

5. Ordnance 1350 – 2011 Budget Amendment (1^st Reading): Mayor Hopkins apologized with the late notice. He is not happy with the accounting consultant and will work to ensure the budget is tracked better in the future. The council confirmed the changes in the budget and that this transfer from reserves of $196,000 meant a total of $266,000 was taken from reserves for the year. The mayor has directed the town maintenance men to be sure they are charging their time to the healthy utility accounts. He confirmed the clerk-treasurer is spending time on the utilities but he expected that to lessen over time. The deficit for the school in 2011 was $40,000. Huson waived the second reading, which was approved 5-0 and the ordinance was approved 5-0.

6. Discussion – Franchise Negotiations: The attorney said the town is negotiating agreements with Puget Sound Energy, Burlington Northern Railroad and Click network. She expected to present the agreements to the council by the first quarter of 2012. Click is only asking to lay empty conduit in the Point Ruston development and they will have to come back for a new agreement before actually laying cable. Hunt said Click had told her they would never provide service to the rest of Ruston. She did not like the idea of only part of the town being served. Hedrick suggested that BNSF give the town the portion of Rust Park that they own in exchange for this agreement. The mayor suggested they also trim trees on their property that are blocking views. Hardin confirmed this is the franchise from 100 years ago. The duration of the new one will be 10 years.

7. Discussion – Employee Medical Benefits: The mayor explained that the medical plan the town currently has is no longer available. There is a similar plan for $20 less per month, but he is reluctant to make any changes until the union has signed off.

8. Ordinance 1344 – 2012 Budget (3^rd Reading): The mayor thanked Chief Kunkel for his work on the police budget. He was able to bring it within $1,000 of last year’s budget. This budget has a $220,000 deficit that will have to come from reserves. The ordinance passed 5-0.

Claims and Payroll passed 5-0 after Hunt questioned some police purchases.

Mayor’s Time

Hopkins thanked Huson for his time serving on the council and asked him to consider sticking around two more years. Hopkins described Huson as well prepared for each meeting and always entertaining.

Council Time

Huson thanked the mayor for his praise and the citizens for electing him. He felt the last two years on the council had been very enjoyable.

Hedrick said he didn’t know anyone who had given more of their time and intellect than Councilmember Huson. His leaving will be a big loss for the community.

Hunt echoed the same sentiments and encouraged Huson to get his application turned in and serve 2 more years.

Hardin described Huson as a mentor and thanked him for his service.

Kristovich called Huson a Ruston rock star and promised to learn how to pound on the table harder while he was gone in his honor.

The meeting adjourned at 8:58 pm.

All Main Roads to Ruston Closed

UPDATE @ 2 pm: Chief Kunkel reports that the northbound lane of Pearl Street is open as of about 11 am, the southbound lane is still closed from 49th to 51st.

Pearl Street is completely closed down for at least a couple more hours according to Ruston Police Chief Jeremy Kunkel. The water main beneath the street has broken and is undergoing repairs. No reports of the residential water supply being impacted yet.

In addition, the sewer replacement project has 51st Street closed intermittently for excavation at the alley (one lane open at times). The tunnel remains closed for construction as well. For the time being, the only way to get in or out of town is using side streets or coming in from Baltimore to 49th. Good luck out there!

Storm Damage Claims

Police Chief Kunkel sent out these details for anyone dealing with storm damage:

The Pierce County Emergency Operations Center will begin today collecting damage information from homeowners and business owners affected by this week’s winter storm. Residents and business owners in Pierce County that suffered damage should call the Pierce County Damage Assessment Center at 1-866-798-6363 (toll free) Monday through Friday between 8 a.m. and 4 p.m.

Callers should have the following information available:

* Name and address of affected property
* Contact information (cell phone, relatives phone number, “new” mailing address)
* Type of insurance (homeowners)
* A description of damage, even if uninsured
* A personal estimate of uninsured losses
* Estimates of the fair market value of the damaged home or business (it is not necessary at this point for property owners to have a contractor’s estimate)

The findings from this assessment will be used by the Governor to request a possible disaster declaration and federal disaster assistance from the Federal Emergency Management Agency (FEMA). This process could take up to a couple of weeks or more. FEMA disaster assistance, if and when it becomes available, only covers uninsured losses.

Among the immediate steps that individuals and families should take include:

* Call your insurance agent to check on your coverage
* Keep detailed records of all clean-up and repair costs, including photographs
* When the time comes to make repairs, be aware of local permit requirements and do a thorough check of potential contractors

Ruston School Likely For Sale Again

The Ruston council recently held a study session to discuss the school building costs and options. Most of the council expressed support for selling the building. Following are my notes from the study session, held December 19, 2011.

Study Session: Ruston School Building Discussion – evaluating current financial position and possible uses and/or disposition of the property.

The mayor called the study session to order at 6:12 pm. Councilmember Kristovich was excused. Councilmember Hunt began by explaining she had been in contact with Jeff Jaygosh, who works for CRB Ellis (a real estate company) and lives in Ruston. CBRE is willing to do a marketing plan but would expect to be allowed to then market the building for the standard 6% commission. Hunt thought they might be able to talk them down a bit on the commission. She had not followed up with them in time to get them at tonight’s meeting. The mayor has authorized them to look at the building and they will get something to the town by early 2012.

The mayor then talked about the current situation with the tenants in the building. Asarco did not exercise their final option year with the lease and Point Ruston now has about 45% of the building on a month to month for $1,725 per month ($2.54 per square foot). The mayor had proposed increasing the rent $8 per square foot, which was not approved by the tenant. The mayor estimated $5.74 is the town’s current cost per square foot.

There was some discussion on the leasehold excise tax, which Ruston has to pay but gets reimbursed by the tenants. Jane Hunt’s partner, Al Olson was asked for his opinion on what the market rate for office space was in the Tacoma area (answer was inaudible).

Councilmember Huson wants to insist that Point Ruston pay $3,396 plus their utility costs to remain in the building. Councilmember Hedrick thought the best the town could do was break even on renting the building but it puts the town in a business they have no expertise in. He felt the best thing was to put the building on the market and sell it. Hunt agreed especially since it gets the property back on the tax rolls.

The mayor confirmed that for the short term he would insist that Point Ruston pay $5.74 per square foot or move out. If that happens, the town will board up the building.

Councilmember Hardin stated again that the council needed to get public input before making a final decision. The Joyce family and others may have concerns about losing the community center. Hunt did not think people would be upset. She had presented the situation to her neighbors and asked them which part of the $50,000 deficit they wanted on their utility bill, but no one had expressed interest in keeping the building. Huson did not think there would be any public interest. He felt putting a note in the town newsletter would be enough.

Hedrick asked if anyone from the public wanted to speak. Al Olson was the only one to comment. He said he was interested in this old ugly building, but the town needed to market it for sale.

The mayor wanted to proceed with paving the parking lots before marketing the building. He said he has asked Ken Brown to reestablish the real estate committee to look at all the town’s surplus properties.

Busy Council Meeting Tuesday

The town council has a big agenda to tackle tomorrow night at their regularly scheduled meeting. Snodgrass and Freeman will present a proposal to do feasibility study on relocating the police department and council chambers so the school building can be sold (details here). The town attorney has issued an analysis of how they can handle the council vacancy (here), although the council had previously invited applications through the end of January for the position. And the ordinance regulating encroachment onto town rights-of-ways will be discussed again (here).

The fun begins at 7 pm at the Joyce Community Center in the school building (5219 N. Shirley Street). I hope to see everyone there, some big decisions could be made on several issues...

Ruston Way Won't Open Til Late April

UPDATE January 17 @ 12:50 pm: Loren Cohen confirmed today that Ruston Way will hopefully open prior to the April 21st date set for the opening event. The run that is scheduled will include both a professional run and a fun run for armatures. The race director has trained others for the Olympics and knows the business well.

Point Ruston announced recently that the new Ruston Way will reopen on April 21, 2012. Local businesses continue to feel the pain of reduced traffic and express disappointment that the promise for an opening in early 2012 could not happen sooner. Progress continues with new curbs laid along the new alignment this week. A party is planned for the road opening on Saturday, April 21st. There will be a 5K race and fun walk to benefit the YWCA and the Tacoma Waterfront Association.

Work has begun again on the Copperline building. Apartments are under construction now and set to open in early fall. Work will then begin on the condos in the building. Condos are priced between $554,950 and 1.5 million.

The sales center on the ferry will reopen on site this summer along with the first part of the waterfront walkway. The rest of the waterwalk should be open over the fall and winter months. There is hope to break ground on the retail core towards the end of 2012. Sonny Brossoit: 1941-2012

Our friend and neighbor Sonny Brossoit was found dead in his home last Tuesday. I understand a family member called for a welfare check after not hearing from him. The police had to break down the door and found Sonny's body inside. There are no signs of foul play. A autopsy is underway with results expected by this coming Tuesday.

Sonny was a regular throughout Ruston, riding his bike and stopping for many an interesting chat. He was bluntly honest, had a ready smile and very handsome ponytail. He was one of the reasons why Ruston is so unique. He will be missed.

Council Meeting: Dec. 5, 2011

The meeting began about 7 pm with the usual procedure, all public officials were present.

Public Comment

Mr. Jaydosh supported installing speed bumps in his neighborhood.

Business

1. Resolution 497 – Authorizing the agreement with JWM&A for engineering and permit review: Councilmember Huson asked how these costs fit into the budget. The mayor noted that the costs are capped in the contract, and most of these charges are reimbursed by the permit holder. The measure passed 5-0.

2. Resolution 498 – Authorizing the agreement with PAC for on-call electrical services: Huson asked the same question and received the same answer on the budget. Councilmember Hunt confirmed that this contract replaces Mo Fesharaki’s services. Passed 5-0.

3. Resolution 500 – Approving the permit for BNSF to build a communications facility at 5030 N. Winnifred: The mayor began by explaining this was a closed record hearing with no further public comment allowed. The town planner outlined the proposal and the conditions attached to the planning commission’s approval (keep the tree in the area and put slats in the fence around the small shed on the alley). Hunt confirmed the location of the fence. Councilmember Hardin asked why this was a second application. The planner said, according to the BNSF representative, that Point Ruston had refused to cooperate with their first proposal to locate the communications equipment on the Stack Hill tunnel – he felt in retaliation for the railroad not allowing Point Ruston’s proposal to attach a natural gas line on that same tunnel. Huson was glad they had applied for the permit before completing construction. Passed 5-0.

4. Ordinance 1346 – Amending Ruston’s noise control standards (2nd reading): Councilmember Hedrick stated this was the third noise ordinance he had seen in his time on the council. This one left enforcement to the discretion of the officer. There was concern that the decibel level in Ruston’s current code was not in the state code. The town attorney felt this kept Ruston’s code consistent with the most recent standards and complimented the two ordinances already on the books. It gives the officer more tools for enforcement; such as when the noise is clearly audible at 50 feet after 10 pm at night. The ordinance had gone through SEPA review as required. Passed 5-0.

5. Ordinance 1340 – Standards for street excavation permits (3rd reading): Huson felt the proposal had not addressed his concerns about the impact on people’s use of their front yards. He did not think permits should be required to landscape the parking strip in front of your home. The town attorney thought it started the conversation about people using town property as their own space. Huson responded that since the town requires residents to maintain the parking strip by their home, if the town was going to require a permit for that work he expected payment for his services. Hardin noted that this draft still required permits for digging within 15 feet of the property line. The attorney will clarify that issue in a new draft for the next meeting.

6. Ordinance 1344 – 2012 Budget: The mayor said he had estimated the revenues conservatively and hoped for more construction tax and sales tax as he and Hedrick continued their research into where the Point Ruston work is paid. Police Chief Kunkel presented the police budget, which had been provided to the mayor but not uploaded for the presentation. The mayor wanted the overtime factored into the salaries; Hedrick liked the separate line item. Hunt said that was not how they did things when she managed for JC Penny, they were not allowed any overtime. Hedrick wanted to look at how other communities provide police coverage, such as Woodway who only pays half of what Ruston does. Kunkel noted that Ruston has the second lowest paid officers in the region. He was proposing a 10% pay increase. Huson stated the town simply cannot afford the proposed budget and called on the chief and mayor to reduce it. Kunkel said he was shopping for medical coverage and thought he could provide coverage for officers and their families for about what the town is currently paying. The issue was tabled until the next meeting (the last of the year) when the budget had to be approved by law.

7. Ruston School Discussion: Hunt presented a proposal (below) for appraisals on the building. She wanted the full scale appraisal for $7,500 and an assessment on what current rental rates should be. The lease for the current tenant expires in January. The mayor suggested shuttering the building to save the $40,000 in costs projected for this year as one option. Jaydosh (who spoke during public comment) is in this line of work and suggested having an agent give an estimate for the building if it was sold, torn down, mothballed, rented, etc. Hardin suggested a public hearing to get input before making a decision. Huson wanted a study session to discuss the options first, then get the public involved. A study session was set for 6 pm on December 19th before the next council meeting. Huson noted the school is part of the zoning code Master Plan, all of which should be addressed. The mayor mentioned he had told Onward Investors when he met with them about the Commencement that the building may be for sale.

Mayor’s Time
Hopkins thanked several folks for helping put on the tree lighting event. He thanked Hardin for attending the monthly staff meeting today. He commented about the angry response from some members of the public now that the town does not give away electricity for free (a strict adherence to the payment policies began when the new town clerk took over).

Town engineer Jerry Morissette gave an update on the sewer project including major repairs at 5308 and 5310 N. Shirley along with other deficits they are requiring the contractor to correct.

Council Time

Huson had no comments.

Hedrick said he had confirmed that the sewer contractor and Point Ruston were paying sales tax to Ruston. He expected the town would see that revenue hit in the October numbers.

Hunt had no comment.

Hardin thanked Santa for coming to the tree lighting ceremony and reminded everyone that he will visit again on the 17th.

Kristovich had no comments.

Growing Up In Ruston

DeeAnn Grip contacted me recently and shared this wonderful memory of growing up in our town in the early 70's, when the school was still open. Thanks for sharing, DeeAnn!

We had a very strong PTA with Mrs. Forch, Mrs. Mecklenberg, Mrs. Beardemphl, Mrs. Joyce, and others. So we had a lot of holiday school carnivals, and the teachers didn't have to worry about a thing. Well, at one point my 2 brothers were old enough to be in school with me, plus we had a preschool brother who would come.

One year (Halloween of '74, I think, 5th grade for me) my brothers and I got the bright idea to use our carnival tickets only for the cake walk. Why bring home plastic spiders and wax teeth when you can win a whole, beautifully decorated layer cake or sheet cake? With the 4 of us in each round, nobody else stood a chance!

We either won every cake available, or all but one. I remember Mrs. Mecklenberg in particular was fit to be tied. She tried to get the teachers to tell us we couldn't do the cake walk anymore, but the teachers wouldn't because the rules hadn't been clear. They never said we couldn't use all our tickets at one game. Then she tried to talk us out of it. That didn't work either.

Fortunately, we had a full sized upright freezer. I can still see myself opening that freezer door and seeing nothing but cakes in there. There must have been a dozen of them! We were set for every birthday, Memorial Day, Labor Day, etc., for an entire year. We thought we were brilliant. Of course, they did change the rule the following year to "one win per child per family," but it was glorious while it lasted.

Council Meeting: November 27, 2011

The meeting for November 27, 2011 began at 7:02 pm with town planner Rob White calling the meeting to order. The mayor arrived within a few minutes. Councilmember Hedrik was absent. Resolution 496 was added to the agenda and the agenda approved 4-0. There were no minutes presented. Chief Torbet gave the fire department report for October. Sergeant Lawless gave the police department report. Jerry Morissette provided an update on the sewer project and the council authorized continuing the work as long as the dry weather allows.

Public Comment
Beth Torbet thanked the sewer contractor for supporting her business by coming in Don’s Market for lunch. The business is suffering with the Ruston Way road closure. She mentioned the upcoming tree lighting event.

1. Ordinance 1346 – Amending the Town’s Noise Ordinance (1st reading): The town attorney felt this would clean up the town’s ordinance and make it enforceable. The town planner said the required SEPA review had been completed. Councilmember Hunt wanted the RCW’s listed in ordinances provided with each draft from now on, but the mayor felt that would involve too much attorney time and drive up costs. Councilmember Huson was concerned that this allowed repeat violations. Huson moved to set a public hearing on the issue, which passed 4-0

2. Ordinance 1340 – Adopting Standards for Street Excavation Permits (2nd reading): This was a public hearing that had been advertised in the paper, although Huson wanted to withdraw the issue from discussion since his previous questions had not been addressed yet. The planner outlined again the reasons for this proposal. Huson confirmed the mayor enforces the permit requirements. Hunt was concerned that residents would not know they needed a permit to dig in their front yards if it was within 15 feet of the right of way. Advertising would be needed to inform people. The planner said other jurisdictions enforce this because of concerns that digging close to a sidewalk or other structure could undermine it – although there are already provisions to require owners to repair any damage they might cause. Councilmember Hardin wanted to know if this proposal had been tested in the courts yet. He was concerned about a future mayor using it arbitrarily or inconsistently.

Public comment reflected the same concerns. The issue was tabled until the next meeting when the town attorney could be present to answer more questions.

3. Ordinance 1344 – 2012 Budget and Public Hearing: The mayor reminded everyone that the budget is available on the town web site and noted the $306,000 projected deficit for the coming year. The only public comment was from Beth Torbet, who felt the fire department ran a very lean operation.

The Fire Chief Torbet outlined his budget, noting the increased cost for vaccinations for fire fighters is required by Labor and Industries. Sergeant Lawless answered council questions on the police budget. Huson did not like the proposed pay increases, preferring a 15% paycut instead. He thought since Tacoma is laying off officers there would be plenty of choices if Ruston officers quit. Councilmember Kristovich said she had not studied the budget in detail yet. Hardin expressed appreciation for all the department does, but did not feel the town could increase pay or medical benefits right now. The budget included new medical coverage for officer families (who have not been covered to date). Hunt had not read the budget in detail yet, but was concerned how the new law regarding liquor sales would impact Ruston. Huson stated he wanted to see a 15% reduction in the overall police budget.

The mayor then outlined the overall budget, calling it very bleak. Councilmember Hedrick had sent word that he is checking to ensure that sales tax on the Point Ruston project gets paid to Ruston. The mayor was hopeful that having the Commencement project back up and running would generate some tax not reflected in the current forecast. He felt the utility funds were doing well but the general fund was hurting. He would talk to council members outside the meeting about ways to charge more of the cost for services to the utility funds.

Hunt was concerned about the cost of keeping the school building open. The mayor noted that there was only $26,000 in rent for the year and a $50,000 transfer into that account would be needed to keep it afloat. He is open to all ideas from shuttering the building to selling it. Hunt will explore appraisal options. She wanted to see the building in private ownership so it could be on the tax rolls. Hedrick sent word that he would rather see the building shuttered than continue to operate at a loss.

Huson felt the town needed to decide if it was going to maintain services or outsource them before making decisions on real estate. He reiterated his belief that the town structure needed to change and be managed by a professional, not a part time mayor. Mayor Hopkins would be gone after this term and the town will probably get another idiot instead. There is a highly intelligent council and mayor right now and that won’t happen again. The town needs to change is structure now to protect from the usual types of leaders running the show.

The mayor noted that the town garbage truck is ageing, as is the town maintenance staff. He wants to look again at outsourcing that service, as well as possibly the local court. He said it is difficult to continue to wait for the Point Ruston development while still providing services.

4. Resolution 496 – Property Tax Levy for 2012: The levy included a 1% increase over the base amount as allowed by state law – passed 4-0.

Record Number of Visitors Next Door

The News Tribune is reporting (here) that Point Defiance Zoo saw a record number of visitors pass through their gates last year. That means a record number of potential customers for our local businesses traveled down Ruston streets. Given the town's continued budget woes, it would be nice to find more ways to get folks to stop on their way to this world-class venue and visit our unique shops. Any ideas on how to make that happen?

Update On 51st & Pearl

As I turned the corner at 51st & Pearl into town last night, I was struck again with how dark that area is after sunset. What was once a bustling commercial area now sits mostly vacant. It turns out at least some of the darkness is because there is no power to the main building that once housed Ruston Galleries.

I got an update from Melissa at Affinity Investments recently (the owners of the building). The 6 apartments above the retail area have been undergoing extensive remodeling for over a year. The power to the building should be back on any day now. The units were stripped down to the studs and rebuilt with everything new, including plumbing and power.

The current work is scheduled to be completed by the end of February. There will be four studio and two one-bedroom apartments. Melissa said rental rates haven't been established yet, but she should have those numbers available soon.

The retail space downstairs is not being remodeled yet. The owners are waiting for a new tenant to sign on and will redo the lower area to meet the needs of the new occupant. The retail space is being marketed by Brent Taynet of CBRE. His phone number is (253) 922-3900. Let's hope the building is soon filled with light and people once again!

Council Meeting: Nov. 7, 2011

I don't usually make new year resolutions, but I do want to get back to giving updates on the Ruston council meetings. I'll need to start by catching up at bit. Here is a summary of the November 7, 2011 meeting. The sound quality on the town's recording makes it hard to hear some of the comments so the summary may miss some.

The meeting began on time with all 5 council members and mayor present. Item 4 on the agenda was amended to just a budget discussion (rather than first reading of the official ordinance). The only public comment came from Jim Wingard about the lawsuit between Point Defiance Casino and the Town of Ruston.

Regular Agenda:

1. Resolution 495 - Selecting the Town’s Official Newspaper: Tacoma Daily Index was designated as Ruston’s official newspaper for required publications. They were the lowest bidder.

2. Ordinance 1341 – Amending the fees for electrical system service and meter installation fees (2nd reading): Councilmember Hedrick questioned the costs listed and Councilmember Hunt was concerned that the ordinance did not note the $1,000 charge for new meter installation was one time only. Mayor Hopkins confirmed that the $250 charge covers the basic cost for the town, which prompted Councilmember Hardin to ask how $1,000 is justified. The existing ordinance already outlined the costs and no one was sure what the reasons were for setting the charge at $1,000 for new meters. The ordinance passed 5-0.

3. Ordinance 1340 – Adopting Standards and Procedures for Street Excavation Permits (1st reading): Town planner Rob White explained that the current grading permit is not consistent with the rest of the code. In looking to fix that, the town attorney suggested updating everything to be more consistent with other jurisdictions. Hunt questioned the proposed provision that requires a permit to dig within 15 of the town right of way. The mayor noted that the right of way extends deep into many front yards. He mentioned a map of the property lines that is available on the town’s web site (I think he was referring to this page).

4. 2012 Budget Discussion: The mayor said the budget had just been sent to the town clerk. Each department head had submitted their own budget and he planned on having each at the next meeting to justify their proposed increases (police and fire specifically).

The mayor then walked through the specifics. The revenue estimates were very conservative and he hoped for more income than is listed. He warned the town is facing some very difficult decisions, including what to do with the school building. There will be improvements made to the exterior of that building when Onward Investors finishes The Commencement (such as repaving both parking lots), but the building does not have enough paying tenants to come close to covering the utility and maintenance costs. He noted the garbage fund continues to struggle.

He is projecting a $308,000 shortfall in 2012, after expecting a $180,000 deficit in 2011 (which does not appear to be as bad as expected). His budget included salary for a part-time utility clerk that may not be needed. Once the new town clerk gets up to speed, she will assess the need for help.

Councilmember Huson stated that he has always felt that Ruston should not be in the landlord business. He felt the town should get rid of any excess property, including the school building. The mayor assigned researching an appraisal on the school, town hall and the fire department bunk house to Hunt. Hopkins said he wants to explore all options, like changing the police department, selling surplus property or others.

Hardin wanted to confirm with the Department of Revenue that Ruston gets all the sales tax due, especially since there is no separate zip code for the town. Hunt asked about auditing Point Ruston to be sure taxes on their purchases are paid to Ruston. The mayor said since their current work is an LID, it is a public process and he already has the town engineer assigned to research that issue.

Claims and payroll was approved 5-0.

Mayor’s Time:
Hopkins noted that the meeting was running late. He is trying to keep the meetings to one hour as a way to save on consultant costs. He had Jerry Morrisette (town engineer) give an update on the sewer project.

Council Time:
Huson referenced the recent flyer from Point Ruston about the nighttime work, calling it a bunch of bull. The reason given (low tide for the shoreline work) did not make since low tide occurs every 12 hours (meaning there is one during the day). There is no need for 12 full hours of work all night. He was upset that the flyer did not include an apology from Point Ruston for the impact on town residents. He felt the town should do everything in their power to stop the work, including issuing citations.

Hedrick did not have any comments.

Hunt agreed the nighttime noise was too loud and they should not be doing any work on the roundabout or other places except the shoreline at night. The mayor stated that he was also very upset. When the nighttime work first started he even went so far as to having the police try to gain access to the site to stop work. Without buying a decibel meter, the town cannot enforce its noise ordinance. The town attorney was also concerned about Ruston's authority to stop work since this is an EPA Superfund project.

Hunt also got permission to research the cost of installing a hump in Commercial Street to slow traffic.

Hardin did not have any comments.

Kristovich did not have any comments.

The meeting adjourned at 8:35 pm.

Bonnie & Clyde in Ruston

I follow the news or web stories about Ruston, which most often leads to stories about the much larger city of Ruston, Louisiana.One of today's stories about our southern namesake involved infamous gangsters Bonnie and Clyde. One of their hideouts was nearby and the final shoot out was just down the road. Ruston's mortician and another witness were kidnapped when they gave chase after the mortician's car was stolen by one of the gang members. You can read more details about the story here...

Meeting Tonight Canceled

The Ruston town council starts their new year with one less council member and no first meeting. There are not enough council members available for the meeting tonight to reach a quorum, so the meeting is canceled. The next meeting will be Tuesday, January 17th at 7 pm at the Joyce Community Center.

In case you don't religiously read your town newsletter each month, here are some tidbits from the December letter I found interesting:

Bradley Huson's long service to Ruston has ended, at least in an official capacity. Bradley served on the planning commission, town council and even as mayor for a brief time.
Dorothy Bailey was elected to Huson council seat, but has since moved to Chicago. She resigned her seat and the town is accepting applications for the open position through the end of January. This will be a two year appointment until the next regular election in 2013. Ruston residents are encouraged to submit a cover letter and resume to town hall. This is a very important service to our community and I hope the council will have many well qualified applicants to choose from.
The dry weather in December allowed the sewer contractor to get a bit more work done than expected, but now that the rains have hit they will likely finish up the current work and stop until spring.
The town managed to end the year while holding onto $3.5 million in their surplus account (mostly from The Commencement project sale several years ago). The mayor noted that the new year still presents many challenges.
The fire department will be offering free CPR classes in late January. Their goal is to have every resident certified in the procedure.
The police department reminds everyone to be careful about putting the boxes from your snazzy new holiday gifts out in the alley. They can become advertisements to wandering thieves about the best place to target.

Leroy "Buck" Linke: 1924-2011

Buck Linke was once a common face around Ruston. He lived on Winnifred Street in an old house that still stands in sharp contrast to the new home next door. He worked for the town, seen here driving the shiny new garbage truck in 1958. He was retired by the time I met him, but he was always full of stories. Despite his rough edges, he had a twinkle in his eye and quick smile. Rest in peace, Buck... You can view his obituary via this link here...

Discussion On School Building Tonight

The Ruston Council is ringing in Christmas week a busy night tonight with discussion about the options for keeping or selling the Ruston School building. The study session for the school starts at 6 pm and the regular meeting begins at 7 pm.

The regular meeting agenda starts with "pine cone exercise" lead by Barbara Nelson, an ordinance that requires permits for digging in the town rights of ways that extend into most of our front yards, and employee medical benefits. And under state law, the council must approve the budget tonight or hold another meeting before the end of the year. It could be a long evening for our public servants and anyone who has time to attend and watch...

Santa Has Arrived!

Santa has arrived at Ruston Town Hall after an exciting, noisy escort through town by the fire department. Police officers were on hand as well to greet the kids young and old, some of whom wanted to pose with their local heroes as well as Santa.

The pick up of toys and food from front porches in town last night brought in quite a haul. We live in a very generous, kind community. Donations won't be delivered til Tuesday, so you can probably drop off more at town hall Monday if you missed the pick up!

In case you don't faithfully read your town newsletter, late this afternoon the fire department will make their annual round to collected toys for the Salvation Army. Leave your unwrapped new gifts on your porch this afternoon and the team will be by to pick them up around 5:30 or so.

Ruston has been the largest donor in years past, so let's see if we can do that again. You can bring your gift to Don's Market or Town Hall as well. It's a great effort by our local heroes for a great cause!

Ruston School For Sale Again?

After epic political battles several years ago, the Ruston Town Council is once again considering selling the local school building. Almost 10 years ago, a previous council sold part of the school grounds for a controversial condo building and gave a long-term lease on the school itself to the developers. After two failed attempts, the condo project is in new ownership and the town has regained full control of the school building and parking lots.

At last night's council meeting, elected leaders discussed getting the building appraised and holding public meetings on the future of the building. Citing on-going maintenance and utility costs with the current budget shortfalls, the council and mayor are considering everything from moth-balling the building when the lease for the current occupant expires in January to selling the building. The mayor noted that he has told the new owners of the neighboring Commencement building that the school may be for sale.

The council tentatively set a study session to continue discussion on the issue for 6 pm on Monday, December 19th (before the regular council meeting).

Santa Came To Town (And He's Coming Back!)

Santa was able to join the festivities for the the Ruston tree lighting party last night, and will return to meet with children young and old in two weeks on December 17th at town hall at noon. Lots of neighbors braved the cold to count down the moment when Steve Taylor plugged in the lights on the big tree. Cookies, hot cider and coffee were enjoyed in front of Don's Market and Town Hall and everyone seemed to have fun ushering in the season together...

Holiday Happenings

Several holiday festivities are planned for December, so plan on joining the neighbors at these events:

Tree Lighting: This Saturday, December 3rd at 5 pm on the corner of 51st and Winnifred; watch the ever-bigger fir tree in the center of town light up with bright colors. Refreshments and Christmas music will mingle with the faithful who brave the cold night, and maybe a visit from the big man in red.
Holiday Festival: Ladies Workout Express will once again host a festival featuring over 14 local vendors with a wide variety of gifts to help with your holiday shopping. The fun runs from 10 am to 3 pm this Saturday, December 3rd at 4939 N. Pearl. Call (253) 752-8599 with questions.
Santa Visit: The Ruston Fire Department brings Santa to town once again. The jolly big fella will tour town on the fire engine on Saturday, December 17th and hang out at Town Hall to greet fans from noon til 3 pm. Town Hall is located at 5117 N. Winnifred.

Tacoma Shoreline & Point Ruston

The News Tribune is reporting today (here) that Tacoma is considering an amendment to their shoreline regulations that would allow Point Ruston to build a limited number of townhouses 50 feet closer to the "ordinary high water mark" than is currently allowed. Under the proposed change, buildings can be built within 100 feet of the shoreline rather than the current 150 feet.

Council Vacancy Process

According to Mike Rooney, manager of Pierce County Elections, here is how the election for Dorothy Bailey will proceed:

Since Ms. Bailey moved out after the withdrawal period, it was too late to formally withdraw from the election.
The county will presumably certify the election with her as the winner since she leads in the votes by a wide margin.
If Ms. Bailey cannot take the oath of office, the council seat becomes vacant.
The town council can use whatever process they choose to fill the vacancy, but they will be the ones to appoint someone to fill the vacancy.
The appointment will last until the next regular Ruston election in 2013 - so the appointment will be for two years, not the full 4 year term that Ms. Bailey was elected to.

I have contacted town officials to see what process they plan on using to fill the vacancy. They have run the gamut from appointing people with no public discussion to inviting anyone who is interested to apply in recent years.

Commencement New Owners Moving Ahead

UPDATE 9:06 pm:

Project spokesperson Tom Elmer responded to local rumors tonight and confirmed there are not any low income or subsidized housing units planned or required as part of the financing package for the building. He said the units will rent for market rate.

The new owners of the twice-failed condo project in Ruston issued a press release this afternoon promising to move ahead quickly to finish the nearly vacant building. Onward Investors, LLC said construction on the luxury apartments should start by early 2012 with new tenants moving in by spring.

The press release acknowledges the cooperation by town officials with changes to the original development plan (more details here). Expected rental rates will range between $1.50 to $1.60 per unit. SACO Construction has been selected as the general contractor and BCRA will return as architect on the project. Click on the image below to enlarge.

Bryan Ficiala Wants Bailey Council Seat

The News Tribune is reporting (here) that Bryan Ficiala mounted a last minute write in campaign against Dorothy Bailey when he heard she had moved out of town before the election. He has 15 votes compared to Bailey's 122. According to the News Tribune article, Bailey plans on resigning and the council will appoint someone to her seat. Ficiala promised to apply for the vacancy.

Sale of Commencement Condos Finally Closed?

I'm waiting for confirmation from the new owners, but two gentlemen stopped by Don's Market when I was there on Wednesday and announced they were with the investors group, which had just closed the sale on The Commencement building over the previous weekend. I was involved in another conversation and did not get the chance to follow up with them personally. They mentioned a press release would be coming soon.

You will recall that Onward Investors LLC secured changes to the development plan from the town council in September (details here). That approval from Ruston did not mean financing was secured or a sale agreement finalized. I'll get more details as soon as I can.... Karen

Newly Elected Council Member No Longer In Ruston

Dorothy Bailey, who was elected to the Ruston Town Council on Tuesday no longer lives in Ruston. It appears the council will have to appoint someone to fill the 4 year term in January. Ms. Bailey responded to my email asking if she was still a resident this morning (below), announcing that she has moved out of state.

Ruston has seen many different seasons, from intense political battles to quiet ignorance. In my time here, this is the norm; where it is a struggle to find someone willing and able to give their time to serve. The political quiet does come with some cost... Karen

I found out we were moving after it was too late to remove my name from the ballot so I will be contacting the mayor to officially resign from my new position. Politics have grown so quiet in town these days, it's hard to even recognize there were two Ruston council races decided Tuesday. With only one candidate for each position, the vote tally for each stands at 100% in each race. As of 3:57 pm today, the votes are as follows:

Nighttime Work at Point Ruston

Point Ruston send the following letter to local residents this week explaining their middle-of-the-night construction work that drew some complaints. Besides the liner being installed along what will be the new public right of way, "shoreline armoring" is nearing completion.

As part of the remediation work required by EPA, the edge of the property along the shoreline will have large boulders placed against the slag to prevent further erosion. Most of the shoreline has been "armored", but the section behind the former docks was inaccessible until last year when the docks were removed. A different federal regulation is driving the late night - early morning work. The endangered species act requires that this in-water work can only be done during the lowest tide during certain times of the year depending on which fish are migrating when. That limited window of time is the middle of the night during these few weeks.

As the Point Ruston team notes, "we hope that the major public benefits far outweigh the short term inconvenience..." The night work should be done in the next 30-45 days. The schedule is available here...

6' Antennae On Train Tunnel

BNSF Railway Company has proposed a 6' antennae on the train tunnel below the Winnifred Street Bridge with an equipment shed on the alley at 5030 N. Bennett (plan details here). Shiny and New

The final touches are almost done to the sewer work on the north end of town. It has been a challenge for neighbors to negotiate the construction, but it helps to know the sewers will flow smoothly for the next 90-odd years, if our last system is any example. Most of the old system was installed in the 1920's, so we've been very lucky to have put off the rebuilding this long. And we get shiny new alley pavement to boot!

Grand Opening: Ruston Trading Post

There is one less empty storefront in Ruston tonight. Bev Wombacher, one of Ruston's most energetic entrepreneurs, has opened the Ruston Trading Post in her building at 4927 N. Pearl. In today's economy, the new venture offers great prices and a place for consignment sales. The Post is staffed with all volunteers and part of the proceeds go to the 24-hour "Relay for Life".

Grand opening celebrations are planned for this weekend; November November 4th, 5th and 6th. There will be raffle drawings, free 5-minute chair massages from 10 am - Noon on Friday and 9 am - Noon on Saturday (donations will be accepted for a longer massage time.)

Although not as busy as year's past, plenty of youngsters (and not-so-young) made their way along the Winnifred Street boulevard to collect treats. The Ruston Police and Fire Departments passed out candy, and even had a little canine help to greet the visitors. Sounds like a great time was had by all!

I know it's for a good cause, but it has been a hassle having our roads and alley torn up the last two months for the sewer replacement project in my neighborhood. But a sure sign of progress was left on my door yesterday with a warning for today: "Sewer main testing tomorrow. Advise closing & weighing down all toilet lids." So far no explosions in the toilets at my house. I hope the same is true for my neighbors...

In case you didn't notice it in the last town newsletter:

Garbage cans may need to be placed on the front sidewalk for pick up. If you can't get your car in the alley because of the sewer construction, the town garbage truck won't make it either. On those rare occasions when garbage pick up hits on a day your alley is blocked, the town asks that you put your cans on the sidewalk in front of your house. This applies to the yard waste and recycle bins too.
The recent burglary at Town Hall highlighted the negative flip side of living in a close-knit, trusting community. Police Chief Jeremy Kunkel noted that after the suspects ran, they received assistance from over a dozen friendly neighbors ranging from using phones, borrowing gas cans and getting rides - all while Ruston and Tacoma police were searching the area for them. No one called in the suspicious behavior at the time. Police ask that you call them anytime you see something that feels suspicious, either by dialing 911 or the non-emergency number at (253) 798-4721. Leaving a message at the police department office can cause significant delays since that phone is not monitored.

Pagoda Update

The News Tribune has a nice update on construction progress at the Point Defiance Pagoda (link here). You may recall the structure was badly damaged by arson in April this year (read more here). Park district officials promise an improved structure that will look basically the same. The Park Board authorized $1.6 million for work recently, with hopes to have the building ready by next May.

In related news, the teenager charged with this arson has pleaded guilty and was sentenced to 142 to 189 weeks in juvenile detention today. The News Tribune story is here...

Sewer FAQ's

Frequently Asked Questions

Why is this project necessary?
Most of the original sewer collection system was installed between 1917 and 1920, and in-pipe video and inspection has revealed that there are many leaks, which contributes to pollution of Commencement Bay. The Ruston Sanitary Sewer Upgrade project will replace approximately 14,000 feet of sewer main, 78 sanitary sewer manholes, and 270 sanitary sewer laterals including 4,000 LF of 6-inch diameter pipe.

How is this project funded?
Funding for this project is being provided by a low-interest loan from the U.S. Dept. of Agriculture, Rural Development Division. This loan will be repaid over 40 years from funds collected from utility bills.

Will my property/driveway/alley be repaired?
The contract with the Town requires that the contractor restore all areas disturbed by construction to their pre-construction state or better. The timing of when this restoration is accomplished depends on many factors, but should occur within a reasonable amount of time from when the contractor is finished with utility work in the area.

What is the procedure for residents to file claims for property damage
resulting from construction?
Please call Charlie Severs, project field representative, at 360-481-4144. He will examine the damage and coordinate with the contractor to resolve the issue. If damage is significant, residents may need to contact the Town Clerk and file a written claim.

What will be the width of the alley repaving?
Although the contract generally calls for repaving only the width of the utility trench (nominally 2.7 feet), the poor pavement condition in many of the alleys will result in additional width of paving, up to and including the entire width of the alley. This decision will be made on a case-by-case basis, depending on pavement condition, other contract requirements, funding limitations, etc.

Will repaving be completed before adverse weather prohibits it?
Construction work will be halted for the season when weather conditions warrant. It is the contractor's intent to get all the locations that are disturbed repaved prior to the anticipated winter shutdown. If some locations are not sufficiently addressed, it will be the contractor's responsibility to keep everything maintained acceptably.

Lawsuit Outcome

The tragic motorcycle accident on N. 51st Street that took the life of Brandon Brooks resulted in a lawsuit against the Town of Ruston (among others) by Brandon's mother. Ms. Brooks claimed that the multiple center lines along that curve of 51st caused the accident.

From what I can gather from court documents, Ruston was successful in getting the lawsuit against it dismissed in August of 2010. The town then sued Woodworth and Company, Inc. who had installed the center lines, for the cost of its defense. The Town was successful in its lawsuit against Woodworth and received a judgement of $80,000, which was paid to the Association of Washington Cities (AWC). AWC is the insurance carrier for Ruston and had provided the Town's defense.

I've asked the mayor and town attorney to confirm this interpretation of the court documents, but they have not responded.

Ruston History On Paper

A small part of Ruston's past has been collected in photos and stories; and is finally available to share. Our town history has been important to me for decades; having lived through the tremendous changes we have experienced in this tiny village. My work with Asarco only increased my love for our unique past. I am glad we have captured some of that history before it was lost.

In Honor

In honor of a good man, a tree was dedicated in Ruston last spring. Former mayor Phil Parker's contributions were memorialized with the dedication of this tree, bought with funds he donated to the town just before his death. You can read more about the dedication here... Town maintenance men finalized the mounting of the plaque into the marble base this week, completing this space where we can now sit and reflect on those who, like Phil, gave so much to our town.

I was privileged to speak at the dedication ceremony. I thought it would be fitting to share those words now that the memorial is complete:

I wish there was something I could point to in Ruston and say “that’s Phil’s legacy”, but there isn’t any such monument that captures his gift to this town. After almost two decades of selfless service, I’m only left with fleeting memories of the issues he championed. He worked alongside Charlene (Hagen) to upgrade Rust Playfield. He led the effort to install a Big Toy there for his kids and others to enjoy.

He was content to see Ruston remain a bedroom community to the greater Tacoma area. I remember when he fought to purchase the Garrison home across Winnifred Street and build an expanded town hall complex. He served on the fire department; he chaired numerous committees and represented Ruston well to the outside world on important issues like negotiating for redevelopment of the former Asarco site. He was always in the middle of any community event, giving his time and energy to make us better.

Phil was a quiet man who listened first before giving his opinion. He was fair and willing to change his position if you presented enough evidence to convince him. He was a bulldog on the issues that were important to him. In that he presented a gentle strength – he’d work as long and as hard as it took to complete the task.

I think one of the reasons we don’t have something concrete to point to as Phil’s legacy is because he wasn’t that kind of man. He would rather work behind the scenes, bringing people together, quietly negotiating an agreement. He recognized and encouraged talent in those around him and easily passed the baton to others if that accomplished the goal.

Even though we don’t have some “glory piece” we can attribute to Phil’s time in leadership here in Ruston, I do know his efforts are a big part of why Ruston still exists today. He worked hard to sustain the town through years of financial struggle while the outside world sat back and waited for us to disappear. Somehow that’s fitting… I think he would want it that way… no big monument with his name in lights… but survival, sustained by hard work and love is his legacy to Ruston. He left us a foundation for a future that we can build on now.

But in many ways this tree will serve as that monument for Phil’s contributions to Ruston. He didn’t build it with his own hands, but it’s a place that reflects the man – quiet, beautiful, strong, a place to pause and reflect on the important things.

In the end, it’s not Phil’s legacy to Ruston that matters. His legacy to world, as it is for any of us, is his children. He loved you Courtney, Kim and Aaron… Each breath you take is in his honor, you carry his legacy of love to a new generation. You can bring his grandchildren to this place now and reflect on his gifts to both Ruston and to you, his family.

As I’ve thought about Phil’s many contributions to my life, I’m reminded that even his death taught me much. One of the biggest lessons I carry from Phil’s life is realizing how important it is to tell each other often how much we love each other – not to sweat the little things – don’t put off till tomorrow mentioning the good we see in each other.

I still miss my friend with the bushy beard, sitting by the window at the little store with his suspenders, florescent pink socks and Birkenstocks. I wish he was here to watch this tree grow, to sit with us and dream big dreams for this town. So Phil, we’ll just have to dream for you. I pray you are at peace now. Know that your town remembers and thanks you today for all your gifts to us.

Update On Commencement Building

The Town of Ruston web site is reporting that the council approved the changes proposed to development plan by the latest group of investors. The primary changes outlined in the ordinances were:

Developers will pay Ruston $520,000 in lieu of the required improvements and parking on the Onsite Containment Facility (OCF). Developers had difficulty reaching agreement with Point Ruston for the parking designed for the top of the OCF. The town can use that money to make the improvements based on their own schedule apart from the project or use the money elsewhere.
The number of units in the building will increase from 60 to 62.
All outstanding fees and expired permits will be paid and updated before work continues.
Several improvements will still be required to allow for unobstructed access for fire equipment around the building.

I note that the exterior lighting that brought so many complaints has been reduced and there is once again some limited activity at the building these days. I am hoping to get a comment from the new investors, Onward Investors, LLC soon.

Too Many Goodbyes

It's so hard to say a permanent goodbye. We hope for better places for our loved ones when they die. We reminisce the old days and wonder how to survive this ever-changing future without them. We hug the survivors and share their tears.

We held a send off potluck for Jim Boedecker last Saturday. His longtime partner, Sherri Forch has been a Ruston mainstay for many decades. Jim went fairly suddenly and shook not only Sherri but many of us into the realization that life is fleeting and precious. Jim was a retired police officer who loved sailing. He worked his garden into a thing of beauty that will live on in his memory. As Sherri has said, we wish him Godspeed.

This morning my longtime Ruston friend Connie Maglione lost her battle with cancer. You may recall that she and I were sued by William Walker a few years ago, just after Connie was diagnosed with cancer. Connie was one of the strongest women I've ever known, as evidenced with how long she fought this disease that, in the end, took her.

Connie and I were not always on the same page politically, which in Ruston can be dangerous. Somehow with Connie, the differences melted away when she cracked a joke or reminded me of our common love for this town. She was jovial, loud and sometimes brash. She had a quick tongue that let you know exactly where you stood with her, be it good, bad or ugly. Even in the midst of her pain and struggle this last year, she always laughed in every conversation and talked of fighting for renewed health.

Connie carries memories and experiences in and about this town that we'll never be able to capture now. She moved to town before the smelter dust had settled. She served on the Civil Service Commission most recently, and on the town council in the past. She loved her family, neighbors and town unfailingly.

The landscape is always changing around here, both physically and in our people. I'd much rather say goodbye (as I have often had to do) when a neighbor moves across town; not this forever goodbye. But it's not a choice I get to make. So to Connie and Jim, farewell. Be at peace, free from pain and suffering. We will miss you and carry your gift of love into the future of this ever-changing town in your name.

New Face At Town Hall

Most residents probably already know, but we have a new (temporary) face at town hall. The mayor decided to let town clerk Myriah Mesa go a few weeks ago. I met the new clerk Judy on Friday briefly. She said she is only filling in until someone new can be hired permanently. I've invited the mayor to comment a few times, but he has not responded.

New North End Art

Despite the rain, local artists Rachel Dotson and Mary Mann were joined by residents and business owners to publicly dedicate two bright new pieces of art in the neighborhood. After speeches and goodies, lots of hugs were exchanged before everyone headed for drier spaces.

Artist Rachel Dotson noted in her speech that she once lived in Ruston and found the area full of beautiful flowers and warm, welcoming people. It was that spirit that inspired her "Ruston Garden" mural; bright, open and full of life. Thanks to both artists for their gift, and to the businesses who allowed their walls to become works of art!

Town Hall Burglarized Monday

It's been a busy week for Ruston's public safety departments. Besides yesterday's fire, police have been busy after two men burglarized Town Hall early Monday morning. They were confronted by the town maintenance men, handed back the equipment they were attempting to steal and took off (one on foot, one by car). Despite a chase, both men escaped.

One suspect has been identified and police will arrest him when he is located. They are still working on the identity of the second suspect. All stolen material was recovered and the investigation is on-going.

Ruston Fire

Ruston Fire Department was dispatched to a house fire at 4921 N. Pearl Street at 2:09 pm yesterday. They arrived to find thick smoke, but thankfully everyone had made it out of the building safely. The house sustained heavy damage. Four people are displaced and are receiving assistance from the Red Cross.

The fire investigator is on scene today, so Chief Torbet was reluctant to share any more details until the investigation is complete. Thanks to the entire crew for another job well done!

Mural Dedications This Saturday

Local businesses continue to give back to the community that supports them. That motivation sets the stage for the Antique Sandwich Company and Don's Ruston Market as they publicly dedicate the new murals on their walls to the customers and neighbors they serve.

Festivities start at 11 am at the Antique Sandwich Company this Saturday, September 17th with speeches and a chance to meet mural artist Mary Mann. Representatives from Tacoma's Neighborhood Council staff and West End Neighborhood Council have been invited as well. It was a City of Tacoma Innovative Grant (administered by the West End Council) that funded the beautiful mermaids on the Antique's wall.

Folks will then stroll down a chalk walk to Don's Ruston Market for a second dedication of the new garden that sprouted on the market wall last month. Artist Rachel Dotson will be there along with Erling Kuester, who is president of the Cross District Association that provided a matching grant for Dotson's mural. The cross district holds one fundraiser each year for their arts program and other support activities for our businesses. Their auction will be held October 22nd at Shenanigans.

Come celebrate these bright new additions to the neighborhood this Saturday!

Two bright new gorgeous murals will grace local walls by the end of today. The new art on the signature side of the Antique Sandwich Company is being installed today. Local artist Mary Mann created this first mural below. She had help from her students at the local SAMI high school, where Mann teaches (News Tribune article with more details here). Another local artist, Rachel Dotson completed the colorful mural on Don's Ruston Market just down the street recently.

A dedication ceremony for both murals is planned for Saturday, September 17th (time to be determined, probably mid-day). Ruston-Point Defiance Business District president Beth Torbet said they wants to dedicate this public art back to the community that supports their businesses. More details to follow on the ceremony, but in the meantime take a stroll along our own art walk!

More Changes for The Commencement Building

Depending on your perspective, the announcement below of proposed changes to plans for The Commencement building can be seen as either good or bad. New owners, Onward Investors LLC is proposing changes to the development plan; removing the requirement for OCF parking and giving the town cash to make whatever improvements it chooses in leiu of that parking and adding two units within the existing building envelope. A public hearing will be held on the issue on Tuesday, August 30th at 7 pm at the Joyce Community Center (Ruston School building: 5219 N. Shirley Street). Perhaps the almost vacant shell of a building will finally see life after all...

Good Bye Tunnel, Hello Future: Opinion

It was finally time to say the formal goodbye today to Ruston's last visible piece of the Asarco smelter that built this little town. It was a different crowd than our usual gatherings these days, drawing the few left in town who had ties to the old days rather than the new families (although there were a few in attendance). The News Tribune has a nice article about the event here...

It was a beautiful sunny day filled with memories and stories of days-gone-by; when the smelter whistle would echo through the streets calling kids home, employees to work and the fire department to action. No watch was needed in those days, everyone knew the time by the length and pattern of the whistle. The whole family went to the smelter doctor if needed, for free. Most walked to work from the adjacent neighborhoods. Community connected with industry just fine.

There were some today that joked about our past and ridiculed our industrial heritage. I understand the viewpoint, and much of the current change is good and necessary. But we forget the hard work that goes into our easy lifestyle and often dismiss the value of those who labor in places like a copper smelter. Smelting and refining metal is dirty, challenging and more complex than most realize. But we affirm the need for it every time we flip a light switch or start the car.

Most important to me are the people who gave their lives to this town and proudly worked at the Tacoma smelter. Their work was good and valuable and important - to this town and to society. They worked hard to purify copper and then came home to work hard to build this town. There may be those who look down on our blue collar past, but its a valuable heritage. It was that blue collar blood, sweat and tears that gave us Ruston. So to the Dockerys and Schonekers and Hights and Lomis' and Campbells and Tallmans and Pudlos and countless others... Thank you for your gift. You done good...

Weekend Fun In Ruston

Besides the end-of-an-era celebration marking the tunnel closure on Saturday (11:30 til 1:30 at the school), Sunday will feature the second annual LaSalle Cadillac Car Show in Ruston. Although the event has run for the car club for 30+ years, our local business district will host the annual picnic here again this year.

The event drew about 100 show cars last year and should bring at least as many this year to line the Winnifred Street boulevard. There will be vendor booths and live music from Malcom Russel and friends. There will be even be prizes awarded, including a piece from a local sculpture artist. The event runs from 9 am until 3 pm (times updated since the flyer below was produced). The print version of today's paper had some nice coverage of our weekend events too. Hope everyone can attend both parties!

Sewer Replacement Starts Soon

These signs will soon be a familiar sight on Ruston streets. Town planners are hosting an open house on Wednesday to let the public know the full extent of the coming sewer replacement project. The aging sewer system has been one of the long-standing concerns for Ruston. The project will mean better service, improved quality for the local treatment facility but also road closures and intermittent disruptions for local residents.

New Color In Town

UPDATE: Thursday, August 18th: Market owner and president of the Ruston-Point Defiance Business District Beth Torbet provided some clarifications today. The grant for the mural on their store is a matching grant from the overall business district association "Art In The District". Our local business district provided matching funds. Beth is applying for help with the remaining $825 cost for this large mural by local artist Rachael Dotson.

The upcoming new mural for the Antique Sandwich Company will be done by another local artist, Mary Mann. This mural is fully funded by the West End Neighborhood Council, one of Tacoma's neighborhood organizations.

Only the locals will get to watch the colorful new mural unfold on the canvas of Ruston Market's wall. Owners are taking advantage of the reduced vehicle traffic of the tunnel closure to spiff up the store. New awning was added last week, a new sign this week and a brilliant, bright new mural is in the works.

The mural is partially funded by the Cross District Association - the umbrella organization for all the local business districts. A second mural from the same funds will begin on the side of the Antique Sandwich Company soon.

Tunnel Goodbye Party

Save the date! The community will say an official farewell to the Ruston tunnel next Saturday, August 20th from 11:30 til 1:30. Construction prevents us from actually entering the structure, so we will gather at the Ruston School parking lot. Point Ruston will provide hot dogs, there will be a giant canvas to sign that will go into a time capsule (to be placed in the tunnel) and we are hoping to hear a recording of the old smelter whistle echo through Ruston streets one more time.

Ruston Galleries Moving

One of Ruston's longtime businesses is moving, although not far. Ruston Galleries, our signature antique shop on the corner of 51st and Pearl Streets is in the process of moving down the street to the former Now & Then antique shop. Business owner Sandy was not sure how long it would take to finish the move, but she should be in her new place soon. The sister shop that featured high quality refinished furniture, Salvage Style, has now closed. The former Coles Tavern next door awaits remodeling.

The new owners of the corner building have been working on a remodel of the upstairs apartment. As part of the remodel, the Town of Ruston required the addition of new awning along Pearl and 51st Streets. The owners have been marketing the retail space where Ruston Galleries has been located for several months. The owners said they would upgrade the retail space to meet the needs of new tenants. The flyer advertising the space is shown below.

The husband of a missing local woman has asked that folks in the north end help watch for his wife, local artist Jessica Smeall. She was last seen at her home at 6th and Mason at about 7:45 pm last night, but she has ties to Salmon Beach and Proctor. KOMO News has a photo (here).

She was last seen without glasses wearing black pants and royal blue shirt. If you see her, please call Tacoma police non-emergengy number at (253) 798-4721.

Smelter Pride

It was a different world back in 1889. The Industrial Age was in its full glory, with the birth of cities and the frontier shrinking. Tacoma was still in its infancy in many ways, wanting to expand and become the largest city in the state. That effort is seen in the following Chamber of Commerce brochure touting the virtues of Tacoma, including this write up of the brand new smelter on the shores of Commencement Bay. The business district has passed out flyers and even taken out a Craigs List ad (here) to announce the community wide garage sale and Barkini Car Wash fund raiser this Saturday. Be sure to stop by the FuSe parking lot for great deals, a clean car and visit any business for maps of all the local yard sales happening around the area.

UPDATE: Wednesday, July 13th: Here are links to a couple more tributes to the tunnel. I am amazed by the interest and how this piece of Ruston history has touched so many...

The Weekly Volcano posted this picture taken right before midnight on its last day here... (along with a comment from the photographer about being contacted several times by local police about what he was doing) and from Kevin Frietas, a well know local blogger here... that includes video of the wild honking that was going on most of the day yesterday.... Kevin has also posted some beautiful pictures of the tunnel in ice during the 2008 cold snap (here).

Last Day To Drive The Tunnel

Ruston Kids Parade

We had another great parade last week on Independence Day - organized by the kids with only a week's notice. But the turn out was better than ever!

Everyone managed to show up with decorated bikes and pets, princesses, flute player and even an official float (aka wagon). Organizer Isabelle Davis passed out the traditional Krispy Kremes to hungry participants at the end to finish off another great event!

Kick Ball Wednesdays

Summer is here! Well, some days…so let’s get together for some good fun with neighbors!

Come on over to the Ruston Town Park on Wednesdays for a fun game of kickball!
We’ll start at 6PM and end around 7:30PM. This is a very informal gathering and meant to just be fun for all. Please feel free to invite others in town to join.

Also, with the closure of the tunnel approaching our business district needs extra love, so remember to support them! Our family tradition these days is to make sure we get to Don’s at least every Friday for the best milkshakes around– YUMMY! We encourage you to do the same!

The town is looking for volunteers to put together a proper send off for the tunnel, which is scheduled to close permanently next Wednesday, July 13th. Folks are asked to call Town Hall at (253) 759-3544 or contact any of the council members listed in the left column here on the blog to volunteer. Let's see if we pull together a great celebration of our past and launch into our future!

4th of July Kids Parade In Ruston Is ON!!!

The annual kids parade in beautiful downtown Ruston will be held again this year. Everyone bring your kids with their decorated bikes, scooters, skateboards and pets to North 51st and Winnifred at 9:30 am on the 4th.

Winnifred Street will be closed from 51st to 54th for the parade. Even if you don't have children to join in the parade, come down, watch and cheer for all these great local kids. It's quite a feast for the eyes with all the snazzy decorations - and it gets your cuteness meter full just in time for the air show and fireworks!

No Lights In Ruston

UPDATE: The power was restored to the Ruston School building and presumably the rest of Ruston this morning at about 9:20 am.

At 3:07 am, the lights went out in town - and a lot of the north end of Tacoma. It appears some Mylar balloons got caught in some power lines and killed two lines. Both lines have to be replaced in order to restore power to the area.

Tacoma Power reports we still have to wait another 2 or 3 more hours till the lights come back on in Ruston. The initial outage took out power to 1545 homes, from North 42nd to Park Ave, Pearl to Mildred and Salmon Beach.

The power has been restored to most of the area now. There are only 450 customers left in the cold right now, from North 45th to Park Ave, including Salmon Beach and Point Defiance Park (presumably the zoo as well).

Quite a summer we are having around here!

It's Official: Ruston Tunnel Closes Mid-July

Point Ruston issued the following press release and detour map yesterday (click on the image to enlarge). The final closure for the tunnel will be Wednesday, July 13th or soon thereafter. There will be signs along Ruston Way with the dates as the closure date approaches. The new road is expected to open in early 2012.

The tunnel will be filled with dirt and the new Ruston Way constructed connecting the bottom of 51st across the base of Stack Hill - at a higher elevation than the current road. The detour directs traffic up Pearl to 46th, then down Ferdinand to Ruston Way.

Businesses along 51st Street will loose most of their commuter traffic, but remain open during this months-long process. Please be sure to visit your local shops during the next 9 months to help ensure their survival. The sewer construction starts in July as well, so traffic will be a challenge.

I think we all understand this is a necessary step, despite the pressures on our local community and businesses. The closing of tunnel marks the completion of an era for Ruston. The tunnel is the last remaining structure related to the smelter that built this town. Regardless of your views on the smelter, no one can deny we started as a proud blue collar town who forged our own way despite the odds.

No one expected Ruston to survive after Asarco closed its Tacoma Plant, yet here we are.... very different than our founding fathers but still standing. I for one appreciate our history and the hard-working families that built this community. So many of them have moved or passed on. I wish they could all be here to watch this final piece of town history be buried with us. It's their faces I see as we mark the end of this era....

Update On Ruston Tunnel

The Town of Ruston released its official findings today from the inspection of the tunnel that was completed on June 17th. The inspection found no reason for concern. The large crack on the Ruston side of the tunnel was mainly unchanged since the last inspection in 2007. You can read the full report on the town's web site here...

Point Ruston Secures Financing

The News Tribune is reporting that Point Ruston has won approval from Bank of America to finance the rest of the Copperline Building. The building will now house apartments rather than condos as originally planned. Construction should begin next month and take about 10 months to complete. More Trouble At The Taste

It turned out to be another ambulance-laden evening at the Taste of Tacoma tonight. Ruston folks enjoying the usual people watching witnessed dozens of police cars rushing to the area as several large fights broke out along Pearl Street and within the Taste.

Early unofficial reports are that there were no serious injuries, but some of the fights involved well over 20 youth in each separate brawl. Police escorted everyone out of the park and had southbound lanes of Pearl Street shut down for a time.

More Public Servants Get Rave Reviews

Ruston police officer Vic Celis received an official commendation from Ruston officials last month for his great work arresting the alleged Pagoda arsonist. You'll recall that Celis stopped the young man riding through Ruston at 1 am on his bike with cans of flammable liquid and matches on his way to the boat house. (Read more here)

The recognition for work well done is deserved - and long overdue for our officers who work hard every day for us. But Office Celis has received another award earlier this month. The Weekly Volcano voted him Sexiest Servicemember. (Read more here)

Celis noted that he loves working in Ruston, especially since local folks wave at him with all their fingers. Congratulations for both awards, Officer Celis! And thanks to all our public safety defenders. You are all a big reason why Ruston is such a special place to live.
