Commencement Condo/Ruston Lawsuit Update

Ruston's council has been fighting The Commencement condo group over the use of their sales center for over a year. The Commencement offered to pay $24,000 for rent in 2007, but the council refused to accept the offer and chose instead to try to force The Commencement out of their space at the Ruston school building by issuing an unlawful detainer. The Commencement contested that action and the trial was held yesterday.

At 9:07 today, Judge Katherine Stolz reached her decision. Paul Wagemann of The Commencement group reports that judge found that The Commencement has not violated their lease, and does not owe rent (now or in the future). They are not required to remove or abandon their sales center. It is likely that no only will the town have to absorb their own legal fees, they will have to pay for any reasonable legal fees that The Commencement incurred defending themselves.

Mr. Wagemann expressed their continued willingness to work with the town. He felt they had made good faith efforts in the past to work with Ruston's leadership. Mr. Wagemann is available to talk to any concerned resident at 627-4367.

I looked to see if the Ruston Connection carried this story, but we know their bias. Just think of what that money (how much!?!) could have been used for - a fire truck, employee wages, additional employees, facility renovations, sidewalk repairs, new street signs, new welcome signs... the list goes on.

We lose $24,000 in rents
that the Commencement was willing to pay. We pay their legal costs and ours.They will never have to pay rent again. That is a HUGE loss for the Town. I am going to share with you something my Grandfather used to tell me. Never look a gift horse in the mouth,
nor cut your nose off to spite your face. We have managed both.

Maybe Jane can come in and fix all of this when she gets her seat next week. Maybe the council can pass a law that says we all have to pay for a subscription the Ruston Connection. I did the math and if we pay whats its worth multiplied by the number of houses in town multiplied by 5 years we actually lose $76. OK so my idea was about as bad as the councils appointment of Jane but nobody's perfect. Well except maybe Bradley..

David Oreck called and wanted to know if he could film a commerical here to see if his vacuum cleaners could suck money out of the Town's bank account as fast as the RC/Cabal. The nutty professor and the grounded pilot would be shown holding the bag.

It's amazing how ignorant people are about this topic. The Commencement "never" had to pay rent according to their lease agreement.
The Commencement "offered" to pay rent and this Town council rejected the offer. "This" town council preferred to go for the throat and throw the bums out and ended up getting spanked!

Now, we the citizens of Ruston, are required to pay all the costs and endure the embarrasment of another "fp" from this council.

I for one know that the Commencement group didn't have to pay rent. Their offering to do so indicated a willingness to have dialogue. Their willingness to speak even now after the legal ruling is another chance at a mutually beneficial solution.
